Summary

Demonstrative evidence is particularly important in truck crash cases. Trucking regulations, industry practices and the physics in play when an 80,000-pound vehicle is involved in a crash are foreign to most jurors. Presenting an effective truck crash case often requires a visual component.

A sophisticated cottage industry has developed to provide the visual assistance lawyers and experts need to help jurors understand and retain crucial testimony in truck accident trials. It is commonplace, for instance, to see computer-generated animations accompanying the testimony of a collision reconstruction expert. These effective demonstrative aids can carry a significant price tag and be the subject of pitched evidentiary battles over their use. Many of these battles are related to FRE 26(a)(2) and FRE 37(c)(1) disclosure requirements.

Be prepared to use demonstrative aids effectively in your trucking case. Tim Semelroth will define demonstrative aids and the broad purposes for which they can be offered. He will discuss the rules governing their admissibility and will dive into rules on disclosure of demonstrative evidence prepared by and for expert witnesses.
