Summary

The presentation will be centered around a recently-tried successful case resulting in a $5 million verdict in a case where the plaintiff's decedent collided with the back of a stalled semi truck on the expressway at rush hour. The truck had been broken down for 14 minutes prior to the collision and many cars had gotten around the truck before the plaintiff collided with it at highway speeds. There was no evidence that plaintiff had applied his brakes. The essence of the presentation will be how to overcome the bias inherent in rear end collision cases due to the assured clear distance and rear-end collision statutes, as well as how to establish a sudden emergency defense to those statutory violations.
