Summary

This presentation will provide an overview of the use of private nuisance claims to secure compensation for harms to private property owners, as well as the more novel theory of "anticipatory private nuisance" as a tool for stopping nuisances before they occur. The importance of using expert witnesses will be discussed. Examples from the context of frac sand mining will be highlighted, but the legal claims can be applied in a multitude of situations.
